How copyright owners request takedowns, and how sellers respond.

1. Overview

PaperCrane responds to copyright infringement notices under the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on PaperCrane (listing photos, listing text, storefront content) infringes your copyright, send a notice to our designated agent. If your content was removed and you believe that was a mistake, you can send a counter-notice. Both are formal legal documents with required elements, and an incomplete notice may not be actionable.

3. Filing a takedown notice

Your written notice must include, per § 512(c)(3):

  1. Identification of the copyrighted work you claim is infringed (or a representative list, if many).
  2. Identification of the infringing material and where it is on PaperCrane. Listing or page URLs are the useful form.
  3. Your contact information: name, address, telephone number, and email.
  4. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

4. What we do with a valid notice

We remove or disable access to the identified material promptly, notify the seller who posted it, and provide them a copy of the notice, including your identifying information. A takedown is not anonymous. The removal is logged against the seller's account for repeat-infringer purposes.

5. Counter-notice

If your content was removed and you believe it was misidentified or removed by mistake (for example, the photos are yours), you may send our designated agent a counter-notice containing, per § 512(g)(3):

  1. Identification of the removed material and where it appeared before removal.
  2. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which PaperCrane may be found), and that you will accept service of process from the person who filed the original notice or their agent.
  4. Your physical or electronic signature.

We forward valid counter-notices to the original complainant. Unless they notify us within 10 business days that they have filed a court action seeking to restrain the activity, we may restore the material in 10 to 14 business days.

6. Repeat infringers

We terminate the accounts of repeat infringers. An account that accumulates multiple upheld takedowns will be closed. A single honest mistake (a lifted photo, replaced when we point it out) is handled with a warning; a pattern of infringement is not.

7. Misrepresentation

Under § 512(f), anyone who knowingly and materially misrepresents that material is infringing (or that it was removed by mistake) is liable for damages, including costs and attorneys' fees, incurred by the other party or by PaperCrane. Do not use takedown notices against competitors' legitimate listings: it exposes you to liability and will end your access to this process.
